    • Everyone has heard of PPI, but not everyone is aware of the impact of the ‘Plevin® rule’. This rule means that you could be owed a PPI refund even if you knowingly bought the policy.

    What is the Plevin® rule?
    ‘Plevin®’ takes its name from a 2014 court case brought by Susan Plevin. The Supreme Court of England & Wales ruled that she had been treated unfairly as she hadn’t been told about the substantial commission earned on her PPI policy. Under this Plevin® rule, if the PPI commission, was excessive and was not disclosed, the court can compensate the policy holder to the full extent of the premium paid plus interest. 

    It is accepted that circa 64 million PPI policies were sold between 1990 and 2010, and that by the End Date for Complaints less than half of all policyholders had been remediated. It is also statistically probable that <40% of un-remediated policies fall within S.140 of the Consumer Credit Act 1974, aka within scope of Plevin. Which means PPI Claims can still be tried in the courts!

     

    Could you benefit from the Plevin® ruling?
    Commission taken on PPI was often in excess of 70% of the premiums. The Plevin® ruling allows anyone who was charged excessive commission which was not disclosed to them to bring forward a claim for repayment of all premiums and interest.

    You can make a claim under the Plevin® ruling if:
    • Over 50% of the PPI sale was a commission – this is known as the tipping point
    • The commission was not disclosed when you purchased the policy

    Even if you have already made a successful PPI claim or your claim was rejected you can claim again on the grounds of Plevin®.
